[+] May 1, 2010 - Is your company covered by OSHA's Hazwoper Standard?
It is important for you to know that the Hazardous Waste Operations Response Standard (HAZWOPER) is applied to five distinct groups of employers as well as the employer’s employees. If your employees are exposed or potentially exposed to hazardous substances including hazardous waste, you are covered by the OSHA’s HAZWOPHazwoperER standard.
Your employees are also covered if engaged in one of the following operations as specified in 1910.120(a)(1)(i-v) and 1926.65(a)(1)(iv):
1. First, employees are involved in clean-up operations that are required by a governmental body. The governmental body could be federal, state, local, or other regulating authority. The clean-up involves hazardous substances that are conducted at uncontrolled waste sites.
2. Second, employees concerned with corrective actions regarding clean-up operations at sites covered by the Resource Conservation and Recovery Act of 1976 (RCRA).
3. Third, employees who are engaged in voluntary clean-up operations at sites that are recognized by the federal, state, local, or other governmental agencies as uncontrolled hazardous waste sites.
4. Fourth, employees working hazardous waste operations in storage, treatment, or disposal facilities are covered. Treatment and disposal facilities are regulated by Title 40 Code of Federal Regulation Parts 264 and 265. Parts 264 and 265 are pursuant to RCRA or by agencies under agreement with the U. S. Environmental Protection Agency to execute RCRA regulations.
5. Fifth, employees who are responsible for responding to emergency operations due to the release or significant threat of release of a hazardous substances regardless of the location of the hazard.
Knowing if your company is covered by HAZWOPER is crucial for the safety of employees as well preventing profit stealing liability issues. Safety Links Inc. offers comprehensive HAZWOPER training as well as the HAZWOPER refresher courses to maintain your organization’s HAZWOPER compliance.
